Terms and conditions of sale

These terms and conditions of sale apply to sales transactions concluded between the company “Domaine le Bois des Dames”, “hotelier”, “establishment” or “accommodation provider”, and the customer.
They apply to all reservations made directly with “Domaine le Bois des Dames” by telephone, e-mail or via its website www.leboisdesdames.com
Any customer making a reservation with the company “Domaine le Bois des Dames” acknowledges having full capacity to contract, and having obtained all the information to make the reservation with full knowledge of the facts.
The general terms and conditions of sale below and the special terms and conditions of each reservation contract form an integral part of the sales contract and must be accepted in their entirety before any sale is concluded. Any booking confirmation implies full and unreserved acceptance of their provisions.

Prices
Prices are quoted and payable in Euros. Prices include VAT. Any change in the applicable VAT rate will be automatically passed on to the customer on the date of invoicing, as will any modification or introduction of new legal or regulatory taxes imposed by the competent authorities.
The rates shown include only the services strictly mentioned in the reservation. Any extras and additional services provided by the hotel during the stay, as well as the actual or flat-rate tourist tax (indicated at the time of booking), will be added to the price mentioned in the booking.
Seasonality of rates: rates vary according to the period. They are specified at the time of booking. The hotelier is free to change its prices at any time.
The prices applicable are those in force on the day of booking, and contractually formalized in the booking confirmation.

Terms of payment
Except in special cases (tour operators, travel agencies, OTAs), payment for all services must be made directly to SAS Domaine le Bois des Dames.
If a deposit is requested at the time of booking, its amount and the terms of payment of the balance are indicated in the special conditions.
Payments are made according to the methods of payment and currency accepted by the hotelier.
Payment methods accepted: credit card (visa, mastercard, maestro), bank transfer, cash.
Domaine le Bois des Dames” does not accept payment by cheque; vacation vouchers are not accepted.

Booking conditions
In order to guarantee a reservation, the customer is asked to provide his credit card details, including: cardholder’s name, card number, validity date and cryptogram; the transmission is made by secure means.
In the case of a “standard” reservation (Flexible), a deposit is paid at the time of booking, and the balance at the latest on the date of arrival, in accordance with the specific conditions of the contract, directly with the hotelier.
The amount of the deposit is specified at the time of booking. In the case of a non-cancellable, non-refundable or non-changeable offer, the full amount of the stay will be deducted directly by the hotelier at the time of booking.
In all cases, reservations are only firm and definitive once all sums due have been paid and the hotel has received confirmation from the customer.
Reservations are personal and non-transferable unless expressly agreed by the hotelier.
Group reservations
If a customer books several rooms, the payment card used at the time of booking will be used as a guarantee for the other rooms.
Members of a group are jointly and severally liable for payment of the sums due to the hotelier.

Gift vouchers
The conditions and prices of gift vouchers are agreed with the hotelier when they are issued. The full amount of the stay must be paid when the order is placed, and the balance at the latest on departure.
The purchaser and beneficiary of the gift voucher are jointly and severally liable for payment of any sums due to the hotelier.
Gift vouchers are valid for 12 months from the date of issue. In the absence of a date on the voucher itself, the date of payment to the hotelier shall prevail. Any voucher not used by its expiry date is forfeited without refund or compensation.
Gift vouchers cannot be split, refunded or carried forward; they are personal and non-transferable unless expressly agreed by the hotelier.

Withdrawal
Pursuant to the provisions of article L.121-21-8 12° of the French Consumer Code, the customer has no right of withdrawal in respect of reservations for accommodation services offered by SAS “Domaine le Bois des Dames”
Modification of a reservation
Modification is defined as any requested change to the initial reservation (category, services, number of people, dates, etc.) that does not constitute a cancellation. Reservations expressly stipulated as non-cancellable and non-refundable cannot be modified under any circumstances.
Requests for changes are subject to availability and express acceptance by the hotelier.
Under no circumstances may they give rise to a refund or credit note in relation to the characteristics and price of the initial booking, even in the event of a change in services and/or the duration of the stay.
Reservation changes are not binding until the hotelier has confirmed them by e-mail (or, in the absence of an e-mail, by post only), specifying the terms and conditions.
In the event of late arrival or early departure, the full price of the stay will be due. No reimbursement will be granted in this case, and the customer irrevocably undertakes to pay all sums due to the hotel without delay.

Cancellation conditions
Cancellation conditions vary according to the type of rate and are specified at the time of booking.
Cancellation of a booking is effective once confirmed by the hotelier, who will specify the conditions by e-mail (or, in the absence of an e-mail, and in this case only, by post)
Bookings expressly stipulated as “non-cancellable, non-refundable” cannot be cancelled under any circumstances.

Cancellation fees
Cancellation fees vary according to the type of tariff and are specified at the time of booking.
Cancellation fees are retained by the hotel as a penalty clause, and cannot be discussed in any way by the customer.
The customer is informed that SAS Domaine le Bois des Dames does not offer cancellation insurance, and that it may be in his interest to take out insurance himself.

Refund/settlement of cancellation fees
If the cancellation gives rise to a refund from the hotelier, the amount is either reimbursed to the customer within a maximum of 15 days of cancellation, or converted into a credit note valid for 12 months, at the customer’s discretion.
In the event of a refund, a processing fee equal to five percent of the amount of the deposit will be charged by the hotelier.
If the cancellation, no-show or modification of a reservation gives rise to a payment obligation on the part of the customer in application of the above conditions, the customer undertakes to pay the sums due within a maximum period of 15 days from the cancellation.
The establishment will debit the total amount of the reservation, or the balance, from the credit card details provided by the customer. In the event that this deduction is impossible for any reason whatsoever (absence of card, expired card, failure by the customer to confirm), the customer is obliged to pay the sums due by bank transfer within a maximum period of 15 days. Failing this, the hotelier will be entitled to pursue payment by any amicable or legal means, at the customer’s expense.
Force majeure:
In the event of cancellation due to force majeure, no charge will be made (unless the reservation is expressly stipulated as non-cancellable)
In accordance with the provisions of article 1148 of the French Civil Code, “Force majeure means any event external to the parties that is both unforeseeable and insurmountable, preventing either the customer or the hotelier from fulfilling all or part of the obligations stipulated in the contract”, notwithstanding any charges or inconvenience that may result.
The following in particular are excluded: all circumstances of a personal nature (illness, loss or expiry of travel documents, legal or family obligations, etc.); non-binding recommendations of a public nature; cancellation or rescheduling of an event for which a reservation has been made; transport disruptions, weather disruptions, etc.

Responsibility
The customer undertakes, on behalf of himself, his assigns or successors in title, persons or animals under his care and responsibility, to comply with the establishment’s internal regulations during his stay, and to do nothing which might disturb the peace and quiet of the premises or third parties, or which might be contrary to public morality or order.
The hotel cannot be held responsible for the theft of goods or objects, except where they have been expressly entrusted to its care with a receipt.
Claims
Any claim relating to the stay must be sent by registered letter with acknowledgement of receipt within 30 days of the stay, failing which the claim will be forfeited, to the following address: SAS Domaine le Bois des Dames 1510 route de Clansayes 26230 CHANTEMERLE-LES GRIGNAN (France).

Applicable law
These terms and conditions of sale are governed by French law and are subject to the jurisdiction of the Court of Romans sur Isère (26, Drôme, France).

Information Technology and Civil Liberties
The information requested from the customer at the time of booking is essential for the proper processing of the request. The only recipients of this information are the hotelier concerned by the reservation request, and any intermediaries or service providers, provided that such communication is compatible with the performance of operations incumbent on the company “Domaine le Bois des Dames” under these terms and conditions, and essential for the execution of the hotel reservation contract and its consequences.
In application of the French law L.78-17 of January 6, 1978, the customer is informed that personal information communicated to “Domaine le Bois des Dames” is subject to computer processing, unless the customer expressly objects. This data processing has been declared to the CNIL. The customer has the right to access, rectify or delete data at any time by contacting the company “Domaine le Bois des Dames” by e-mail info@leboisdesdames.com
